LA Federal Court Highlights Phil Favro’s ESI Expertise

A Los Angeles federal court recently highlighted the expertise of Favro Law PLLC Founder and President, Philip Favro, in connection with its order imposing spoliation sanctions against Los Angeles County and other government parties. In Lee v. County of Los Angeles, No. 2:23-CV-06875-GW-MAA, 2025 WL 2505484 (C.D. Cal. Aug. 29, 2025), the court found that Los Angeles County and other County defendants failed to take reasonable steps to preserve relevant text messages and issued a mandatory adverse inference jury instruction against defendants. In reaching this determination, the Honorable Maria A. Audero observed that text messages are particularly probative evidence in many instances since they “may reflect a party’s views unfiltered for publication.” Id. at *20. Judge Audero went on to cite Phil’s expert testimony regarding this topic from Oakley v. MSG Networks, Inc., --- F. Supp. 3d ---, 2025 WL 2061665 (S.D.N.Y. 2025), i.e., that text messages “generally memorialize unguarded communications and contemporaneous observations that cannot be replicated through other forms of discovery.” Id. NY Federal Court Highlights Phil Favro's Expert Testimony

A New York federal court recently relied on expert testimony from Favro Law PLLC Founder and President Philip Favro in connection with its order imposing discovery sanctions against former NBA basketball player Charles Oakley. In Oakley v. MSG Networks, Inc., --- F. Supp. 3d ---, 2025 WL 2061665 (S.D.N.Y. 2025), the court found that Mr. Oakley failed to take reasonable steps to preserve relevant text messages and issued an adverse inference jury instruction and other sanctions against Mr. Oakley. In reaching this conclusion, the Honorable Richard J. Sullivanrelied on expert testimony Mr. Favro offered to determine that neither Mr. Oakley nor his counsel took reasonable steps to preserve Mr. Oakley’s text messages under Federal Rule of Civil Procedure 37(e). Recognizing “Mr. Favro’s extensive experience and rigorous analysis” in the field of ESI and electronic discovery, Judge Sullivan found his testimony regarding the reasonable steps to preserve standard to be “more persuasive by a wide margin” over that of an opposing expert. Mr. Favro was retained by defendants MSG Networks, Inc., The Madison Square Garden Sports Corp., and Sphere Entertainment Group, LLC, who are represented in the litigation by King & Spalding LLP.
